ALL CLIENTS of Fasting Center International, Inc., worldwide, agree to all of the following statements in this online, legally-binding, e-commerce Juice-Fasting Agreement. You're hereby also agreeing not to attempt self-supervision of our Program beyond the length you're paying for--now or at any time in the future--understanding that you're wholly unqualified to do so, and can seriously harm yourself without even realizing how, as things can arise in longer Programs which may never be seen in shorter ones, on three critical levels--physiologically, psychologically and spiritually.
        Filling in, below, your personal and payment information and clicking the 'Send' button, constitute your 'electronic signature' initiating this two-way Agreement, entitling your purchase and undertaking of FCI's Program, understanding that the receipt, by you, of any portion of our Program's copyrighted, intellectual property confirms that this two-way Agreement is irrevocable and irreversible, meaning that intellectual property cannot later be returned by you for any reason(s) whatsoever, and that there are no refunds. No exceptions, period. FCI will email the first part at our earliest convenience upon receipt of your order--as noted in the autobot Receipt you'll be instantaneously emailed--in case you wish, as many clients do, to begin your Program before the remainder arrives via FedEx or alternative delivery.
        You're also agreeing that our Program you purchase will be used exclusively by you, as any and all types of 'sharing' or 'uploading' of any or all portions of FCI's FASTING PROGRAM^TM or 60-page LIFETIME OPTIMUM HEALTH PLAN^TM, protected under U.S. and International copyrights, is an infringement of U.S. Copyright Law (for which the maximum penalty is a $100,000 fine and five years in prison), as well as of all international treaties; may result in civil and criminal penalties, and will be prosecuted to the maximum extent possible by the laws, as all paying FCI clients, globally, expect.
        And because it has happened, FCI emphasizes that this means you may not share our Program with your spouse, significant other, family member, relative, friend, health-care practitioner, or anyone else. Most recently, for example, FCI successfully sued a Swiss financial consultant who allowed his wife to purloin our Program, which we learned when she had the audacity to telephone FCI with supervision questions, replying when questioned about why she was doing our Program without being our client: "C'mom. . .I'm his wife!!" FCI, over the 35 years we've been blessed as the global leader in our field, because we continually hear tragic, health-damaging stories about foolish souls attempting unsupervised fasting--flying blindly by the seat of their pants into the virtual unknown--has never and will never allow anyone to do our Program without our skilled, veteran, professional supervision, available only to our our actual clients in 220 nations. Obviously, since all human body-mind-spirit complexes are unique, no two fasting experiences are the same, on all three critical levels; hence, the absolute need, initially, for intelligent supervision.
        Obviously, since FCI's is a scientific DEtoxification Program, you're also agreeing to leave behind ALL health-damaging addictions throughout our Program, including the obvious--alcohol, caffeine, nicotine, drugs not prescribed by a physician for a specific health problem, etc. In other words, with the stated exception of physician-prescribed medications, you're agreeing that if it's not included in our TRANSITIONING-IN PROGRAM^TM, FASTING DAYS PROGRAM^TM or TRANSITIONING-OUT PROGRAM^TM , you will leave it behind throughout our Program, just as do all other FCI clients, worldwide.
        Agreement, by you, to all of these and the additional conditions below, indicated by your 'electronic signature' in filling out the below form, is an investment in your own health, happiness and healing power, which pays for itself over and over and over again, as you will then have this marvelous, self-improvement technique for life, and can use it with confidence (again, fasting only up to the length of time you've actually paid for FCI's supervision of)!

Noble new FCI clients, worldwide, kindly forgive the necessity of this requisite legalese, understanding that a few everywhere in today's world of global e-commerce necessitate it. For the vast, honest majority, however, our two-way relationship is mirrored in these comments from His Holiness the Dalai Lama's "Ethics For The New Millennium": "Peaceful living is about trusting those on whom we depend, and caring for those who depend on us." Mutual respect has always been honored here at FCI, as brilliantly reflected in the post-fast testimonials of the many physicians currently gracing our website's home page.
        To become an FCI client, you therefore are agreeing to all of the above, as well as the following:

• I do not suffer from any serious condition or disease requiring the monitoring of a physician, such as ADD, severe allergic reaction, amyotrophic lateral sclerosis (ALS, or Lou Gehrig disease), severe bipolar disorder (a.k.a. manic-depressive illness) and am not taking Lithium, Cushing's Syndrome, FSGS (familial focal segmental glomerulosclerosis), HIV/AIDS, SARS, H5N1 or other Avian flu, cancer, cardiovascular disorders, diabetes, gall bladder and/or kidney problems or stones, heart disease or arrythmia (including use of a pacemaker), multiple sclerosis, pancreatitis, Parkinson's disease, pulmonary disease, tuberculosis, mental illness, or psychological imbalances such as generalized anxiety disorder (GAD) or hypochondria. If so, I'm advised to consult with the physician(s) monitoring my condition, and must, before sending this Agreement, tell FCI of its history, as some conditions are contraindications for fasting; thus, inquire if in doubt.
          Those with a history of stones, or who've had a colectomy or hemicolectomy, must advise FCI of that, and sign the necessary waiver. Likewise, FCI makes the sole determination regarding whom it will allow to do our very shortest Program, on a signed-waiver basis (and upgrade it only in 10-day segments, if there are no contraindications) from among prospective clients at advanced ages (above 70) or suffering: acute anxiety disorder, bypass/stent or open-heart surgery, cluster headaches, major depression, diabetes Type II (fasting's contraindicated for Type I's), a history of gall stones or kidney stones, lupus, mental illness, multiple sclerosis, neuropathy, severe neuroses, schizoaffective disorder, suicidal ideation, et. al.
          Pregnant or nursing mothers may not fast, nor may the extremely malnourished, nor children under 18. Similarly, FCI does not accept, as clients, those suffering atrial fibrillation, manic-deperssive illness (a.k.a. bipolar disorder), or taking anti-convulsant or anti-epileptic drugs to control grand mal, psychomotor, myoclonic, and focal seizures, nor do we accept clients on diuretics (egs., Furosemide, Lasix or Spironolactone), anticoagulants (egs., Coumadin or Plavix), or drugs for congestive heart failure (eg., Digoxin). Finally, no 'diet drugs' may be taken on FCI's Program, nor are they necessary.
          That said, however, know that FCI, over 35 years of supervising our world's largest fasting clientele (on seven continents), has had many clients taking various medications, including antidepressants and drugs for ADD, anxiety, birth control, various heart/blood medications, hormone-replacement therapy, meds for migraines, thyroid deficiency, etc. FCI instructs all who become clients specifically how to take these, so they have less tendency to hang up in the stomach and kick back in the brain's appestat mechanism, and thus unnecessary hunger/appetite, and perhaps a consequent 'weak' feeling.
          Additionally, FCI recommends that all clients on drugs prescribed by their physician continue taking those drugs, until the client and physician who prescribed them, together agree they are no longer necessary. Do, however, educate yourself on their possible side-effects, so you know what may be causing such things, understanding that all drugs are toxic, and can cause negative side-effects. See halfway down our Solution page for our longer list of "Who Should Not Fast."
  
• I understand that I am receiving no medical advice, diagnosing or prescribing, and I am fully advised to consult with my physician(s) if any medical complications do arise during my fast. Although scientific, therapeutic fasting has no history of causing any such complications, I understand that cumulative medical problems associated with both excess weight and toxic conditions may occur at any time in life, even while doing a scientific, curative fast (although intelligent fasting, historically, has long proved its efficacy as a natural, therapeutically beneficial, and a very inexpensive preventive method for improving and maintaining health, as well as a proven, cost-effective therapy for resolving numerous health im-balances and dis-eases).
  
• I understand that because FCI's Programs are nonresidential, and also because my own less than optimum health condition is a direct result of my entire lifetime of both dietary and lifestyle behavior, for which FCI had absolutely no responsibility, that I am entirely responsible for my own health. Therefore, I, for myself and anyone entitled to act on my behalf, hereby waive and release FCI from any and all claims for health problems or personal injuries I may encounter while I am undergoing my FCI Program or afterwards, either now or throughout my entire future, as FCI is providing me with this marvelous, self-improvement technique for the rest of my life (although I understand the supervision lasts only during my initial Program, as FCI cannot advise and/or supervise it's global clientele in perpetuity; therefore, I agree to ask any and all questions during this supervised Program and keep that advice for reference during my future fasts).
  
• I understand that FCI reserves the right to choose its clientele vis a vis established parameters, as well as to cancel any Program if and when the Director deems it necessary, at any stage, in which case I agree FCI will refund the prorated portion of my fee, less the FedEx shipping charge and two-way, credit-card processing fees. I also agree not to hold FCI responsible for delivery problems with FedEx or alternative delivery services; any telecommunication failures by its Internet Service Providers; power outages by its phone companies; periodic computer system crashes and/or Internet traffic congestion, as well as any disruptions in electrical power, telecommunications, banking, food distribution, etc., globally, but I do expect FCI to resolve all such issues as expeditiously as possible.
          I also understand that my communications with FCI will be via email (or by phone, if deemed necessary by FCI); that FCI will respond at its very earliest convenience (on its fair, global, first-come, first-served basis--unless yours appears to be the exceedingly rare emergency--generally within 24 hours, and normally during the same day, unless your emailing comes in after normal business hours that day, since we have lives, families, and need both down-time and sleep, just as you do), but that FCI does not fax clients, nor does it import any documents or attachments (as data-destroying macroviruses can be picked up enroute, completely unknown to or unintended by you).
          I also hereby agree with FCI's 35-year decision to treat all clients equally, worldwide, vis a vis our long established policy regarding our emailing of nonconfidential 'windows' in on kindred souls' experiences, understanding that these are sent entirely at FCI's discretion, and only in response to individual requests (never on weekends--when FCI advises all clients to get out from behind their computer screens and enjoy doing things they might not be able to during the week--but otherwise are automatically sent whenever one elects to check in, even if one has no questions and wishes only inspiration, in which case s/he simply emails FCI saying: "Please send today's 'windows'."). In other words, 'windows' do not come via blanket mailing orders, nor in advance of the day one's actually on, nor in 'make up' orders for days already passed (again, I agree not to request them on weekends, understanding that FCI employees have lives and families, too, and already work 7 days a week, 365 days each year).
          I further agree that FCI makes the sole determination if, when and how many 'windows' will be sent, understanding FCI recommends against any client establishing any kind of 'daily check-in basis,' as we do not want our clients creating an unnecessary umbilicus, so that they think they can't do this magnificent discipline without us in the future, since we're teaching this marvelous, self-improvement technique for life; besides, as "Washington Post" research discovered: "The 26,000+ popular 'diets' which have come and gone during the past 70 years have failed Americans 99.5% of the time!", and 'daily check-in's' are one of their hallmarks, obviously part of such universally failed policies.
  
  
• I further understand and agree that:

1. The FASTING--PROGRAM^TM, whether FedExed or emailed, is the entire copyrighted software product (for my own human hard drive) or intellectual property for which all FCI clients pay, the fee for which also will include FCI's nonpareil, skilled, veteran, professional supervision throughout my entire Program length. In other words, I understand that FCI does not market or provide the liquids or products I may choose to consume or use throughout my Fasting Program, although my Program does include all of the necessary transitioning and fasting information on what I'm to consume/use throughout, along with suggestions on what works best and may also be available in my area of the world, from local retailers or on the Web. I further understand that it is entirely my responsibility to initiate all my Scientific Fasting Program's supervision contacts, as FCI would otherwise have no way of knowing at what minute of what hour of what day I might have questions arising, on all three levels.
   
2. I agree to pay my entire Program fee before any portion of that FCI Program is emailed, FedExed or mailed to me. Also, I completely agree that my total payment is absolutely nonrefundable for any reason or reasons, whatsoever, once I have received any portion of the abovementioned FCI Program as clearly stipulated (understanding one portion will be emailed within 24 hrs., and the rest sent via FedEx or alternate shipping method), having freely 'signed' this e-commerce Agreement in the manner stipulated above, regardless of whether I choose to begin my Program now or in the future, or even if I choose to terminate my Program prematurely, for any reason or reasons, whatsoever. I agree this means I may not return my Program package or refuse its delivery, once ordered via this online Agreement and FCI has shipped it, after I've already received via email a portion of it's copyrighted, intellectual Program property.
           FCI does allow clients to break their Program into two, separated and supervised phases, in case of either a necessary, premature fasting disruption, or simply a client's personal, mid-fast decision to do so. Life complications do arise, and FCI is happy to adjust with any such client decision. I understand FCI clients achieve an unparalleled 98.5% Program-success rate, but in the rare event I elect to choose this option--or even if I choose not to begin my Program within a reasonable time after ordering it--I agree to use ALL my remaining, nontransferable days within one year of signing on, understanding that FCI stands ready to provide its service throughout that entire year for me (with the single exception at this paragraph's end), just as athletic clubs the world over sell one-year memberships and make their gyms available, whether clients elect to use them or not during that contract period. . .just as we pay automobile clubs and insurance companies for one-year policies which offer service throughout that entire year, whether we 'use' them or not. I further understand there are no exceptions to this long-standing policy, since FCI has always treated all clients equally. I also agree that if I choose not to complete my Program within one year of signing on, I'm forfeiting my Program and FCI's supervision of it, agreeing it cannot be done after that one-year cut-off, nor can any Program materials be replaced in some later year. The single 'time' exception is that in the rare instance FCI is closed for sabbatical or any other reason, my 'one year' time frame is automatically extended by the length of FCI's sabbatical/closed period. Similarly, I agree that if I fail to start or complete my Program before FCI closes for any such sabbatical period, I will do it, or what remains of it, after they re-open.
   
3. I also agree to pay the shipping and handling fee which I hereby authorize to be automatically added to my Program fee, understanding that if I live inside the contiguous 48 U.S. States, I'll pay a $25 fee for my Program package to be shipped via FedEx 2-Day delivery. However, should I request the Fedex Standard Overnight (next business afternoon), weekend or holiday delivery, I agree to pay that differential, as well. Or, if I live outside the contiguous 48 U.S. States, I'll pay whatever the FedEx International Priority fee is to ship me my Program package, as well as any Customs Duties (rarely does any nation ever charge these--only once in FCI's 35-year history).
           I appreciate FCI and Federal Express teaming up to ship my Program package as fast as anybody on Earth, agreeing that in this age of identity theft, since all credit card companies now require, with online purchases, "signature proof of delivery," in order to make your life easiest in this regard, FCI, long preferring to work on the basis of trust, will FedEx Program packages to all clients within the continental U.S. with an "indirect signature required," meaning FedEx may obtain a signature in one of three ways: (1) from any person at the delivery address; or (2) from a neighbor, building manager or other person at a neighboring address, or (3) the recipient can sign a FedEx door tag (left after they've unsuccessfully attempted delivery) authorizing release of the package without anyone present. All shipments outside the U.S. will arrive with a 'direct signature required,' meaning the person who ordered it must sign for it.
           To aid your planning, FCI will have FedEx email you notice of your package's shipment, along with its Tracking Number, so that you can pull up FedEx.com and track its progress, or call FedEx toll-free to arrange delivery (inside U.S, 800-463-3339; outside, 866-477-7532). However, in the rare event FedEx twice attempts delivery and fails to obtain the required signature, you're hereby agreeing that your credit card will automatically be charged for FedEx to ship your Program package back to FCI's California headquarters, as well as for the shipping and handling fee for FedEx to re-ship your Program package to you.
   
4. I further agree that if I later indicate via email or phone that I'm extending my Program, I will pay FCI the extension differential on or before the end of my earlier segment. If I fail to do so by that date, I hereby authorize FCI to charge my credit card for the full extension I've indicated it's my intention to do, regardless of whether I send the hereby requested, upgraded Agreement form or not. I also agree that my failure to send the hereby requested, upgrade Agreement will not relieve my contractual responsibility, after indicating to FCI via email or phone that I'm extending and/or have begun to do so, having hereby given FCI the authority to charge my credit card in full for that entire extension. . .whether I later elect to use it in its entirety or not (the identical stipulation which applied to my original order). Finally, I also authorize FCI to charge my card for any extension I do by 'accident,' such as 'forgetting' how many days I've done, just as if I 'forgot' to return a rented car on time, I'd expect to pay for the additional days using it. ;-)
           In the odd event my payment to FCI is delayed in any manner, I understand that I am liable for a 1.5% monthly service charge on any past-due balance (annual rate totalling 18%). Additionally, I agree that no portion of my Program can be transferred to anyone else for any reason, whatsoever, and vica versa. This includes those fasting together using FCI's 'Couples' Discount.'
   
5. Additionally, I agree that if qualify for and am given the 'Couples Discount' but, for any reason whatsoever, fail to start my Program within 15 days of the date my coupling partner sent her/his Agreement, that I've failed to qualify my partner and I for the 'Couples Discount' granted us initially, and hereby give my permission to FCI to retroactively charge both of us the same, non-'coupled' Program fees all others pay, worldwide. I understand FCI treats all clients equally in this regard, worldwide, and again agree that both I and my fasting partner will, should I fail to honor this 15-day cut-off, each be charged the discounted differential we subsequently failed to qualify for, agreeing there are no exceptions to this long-standing policy.
               FCI considers any two people fasting together as a 'couple.' You do not have to be related, or even living in the same State or country. . .just signing on for Programs together, and fasting at the same time. I understand and agree to honor FCI's 15-day 'grace period' between the times each 'coupling' client must actually begin her/his Program, if necessary to accommodate differing schedules (never longer). I agree that even though FCI will even allow 'coupling' clients to send their Agreements up to within 15 days of each other, both Programs must be started within that same 15-day grace period (again, which I agree begins when the first sends her/his Agreement).
   
6. I understand that should I elect to extend my Program beyond the stipulated days, I'll likewise pay that amount, in advance, at a US $9.95/day rate. Again for emphasis, I fully agree not to attempt self-supervision of FCI's Scientific Fasting Program beyond the length I am paying for--now or at any time in the future--understanding, it's worth repeating, that I'm wholly unqualified to do so, and can seriously harm myself without even realizing how, as things can arise in longer Programs which may not be seen in shorter ones, on all three critical levels--physiologically, psychologically and spiritually.
           I agree, too, to ask all questions during my Program, understanding that my fee does not include post-fast advice, support or supervision in perpetuity, since FCI will then be focused on serving current clients on all continents and in all time zones, along with the hundreds of prospective clients visiting our Virtual Office each day of every year. Likewise, I understand that while FCI will address all issues germane to my own, current fast--as determined wholly by FCI, based on reported symptoms and health problems of mine--it purposefully does not do psychological counseling; does not teach in-depth sciences such as biochemistry or physiology, nor does it provide a library service on non-germane subjects or the more than 500 medical-journal articles on scientific fasting research, as doing so would take inordinate time away from FCI's number one responsibility of helping its global clientele resolve as much unnecessary suffering as possible. I understand this means I'll ask FCI to address questions and germane subjects when they actually arise during my Program, and not as one inordinately lengthy, time-consuming list at or near my Program's end.
           I also understand that if I elect to do a repeat Program within one year of my previous one at full fee, my partially-discounted fee (contact FCI for specifics, if interested in doing such a Program) does not include FCI FedExing to me another Program package or emailing the New Client Letters again, since I'll already have those, and no client is ever sent duplicates. This stipulation also applies if, as an above-stipulated repeat client, I opt for a larger Couples' Discount by doing this repeat Program with another, first-time client (such repeat clients may choose whichever discount they prefer, but never both).
           Beyond that, I agree that FCI has advised me to intelligently keep, for future years' reference, all pertinent FedExed Program materials, New Client Letters, any germane subject letters I may request during my Program, as well as any email communications or 'windows' sent me, understanding that FCI's moderate fees do not include re-sending any of these (not to mention the precious time that would take away from my suffering sisters and brothers FCI serves on seven continents), either during my current Program, in the future, or even during a discounted, repeat Program I might elect to do within one year, although I may request any of them for the replacement fee FCI will stipulate. (Single exception: FCI will re-send 'windows' in on fellow fasters during repeat Programs, again within the stipulations I've agreed to above, as well as address my fasting supervision questions throughout my repeat Program, of course.)
           Finally, by hitting 'Send' below to join FCI's global clientele, understanding that perhaps 75% of the email we all receive today is unsolicited spam, I agree to familiarize myself with my Internet Service Provider's (ISP) "junk mail" or "spam" folder, where I hereby agree to right now add (FastMaster@fasting.com) to my "Approved Sender's" list there, so that FCI's 20-odd New Client Letters and any future emailings are not incorrectly quarantined there or returned to FCI as "undeliverable" (as "unsolicited mail" by my mailserver's anti-spam filtering software). I agree this is my responsibility and not FCI's, just as it is my responsibility if my ISP has a mailserver problem which causes FCI' emailings to me, to unnecessarily be returned to them as undeliverable (in which case I hereby agree to take several minutes and immediately set up a free e-account at another ISP such as Google.com or Hotmail.com--not at Yahoo.com, as they've had many such mailserver problems since the beginning of 2006 and as recently as January, 2009, wasting much FCI time in re-sending multiple "undeliverable" emailings we've sent perfectly well the first time, or wasting our clients' and our time in the back-and-forth required to track this problem, until the client 'discovers' all those New Client Letters sitting in their Yahoo junkmail box).
            Thus, I'm now agreeing to be wise and avoid the $5/letter fee which FCI charges for any letter a client requests us to re-send because they've unfortunately chosen not to follow FCI's here-stated advice to immediately create a Fasting File on their computer and back it up to intelligently preserve it, or because they mistakenly 'deleted,' 'misplaced' or 'lost' it before doing so, and especially if the dog ate it! In other words, I agree to take responsibility for any failures my own actions/failures may cause in this regard, and not project them onto FCI, realizing my actions have consequences, and I agree to own those resulting from any failure on my part to take the simple, abovementioned, proactive precautions for avoiding just such unnecessary, unfortunate, time-wasting problems. Wheww! To repeat, thank you noble new clients in 220 countries for your exemplary patience, and kindly forgive the necessity of this requisite legalese, understanding that a few everywhere in today's world of global e-commerce unfortunately necessitate it.
